Terms of Service

1. Acceptance

By accessing or using Kayaan, you agree to these Terms. If you are using Kayaan on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

2. Use of the service

You may use the platform only in compliance with applicable law, FMCSA regulations, and the customer agreement between your company and Kayaan. Prohibited uses include reverse engineering, unauthorized access, abusive scraping, or using the service to facilitate fraud.

3. Customer data

You retain ownership of customer data you submit to the platform. You grant Kayaan a limited license to process that data solely to provide the service.

4. Fees

Fees are defined in your order form or subscription agreement. Demo access is free. Production use requires a signed agreement.

5. Warranties and disclaimers

The service is provided on an "as available" basis. Except as expressly stated in a written agreement, Kayaan disclaims implied warranties to the extent permitted by law.

6. Limitation of liability

To the maximum extent permitted by law, Kayaan's aggregate liability is limited to the fees paid by you in the twelve months preceding the claim.

7. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
